By using the ObservePoint Web site and its services, you agree to be bound by the below Privacy Policy and Terms and Conditions. We may update and modify these Terms, including our Privacy Policy and Terms and Conditions from time to time, and by continuing to use the site after posting of a modification, you accept the modification. Please note that special terms and conditions govern the use by customers of the ObservePoint site, as outlined below.

1) User Conduct and Responsibilities

You agree not to:

In addition to any fee of which you are notified, your provider's standard messaging rates apply to our confirmation and all subsequent SMS correspondence. You may opt-out and remove your SMS information by sending "STOP", "END", "QUIT" to the SMS text message you have received. If you remove your SMS information from our database it will no longer be used by us for secondary purposes, disclosed to third parties, or used by us or third parties to send promotional correspondence to you.

7) Detailed Wireless Policy

Data obtained from you in connection with this SMS service may include your name, address, cell phone number, your provider's name, and the date, time, and content of your messages. In addition to any fee of which you are notified, your provider's standard messaging rates apply to our confirmation and all subsequent SMS correspondence. All charges are billed by and payable to your mobile service provider. We will not be liable for any delays in the receipt of any SMS messages, as delivery is subject to effective transmission from your network operator. SMS message services are provided on an AS IS basis.

We may use personal information to provide the services you've requested, including services that display customized content and advertising. We may also use personal information for auditing, research and analysis to operate and improve our technologies and services. We may share aggregated and non personal information with third parties outside of this service. When we use third parties to assist us in processing your personal information, we require that they comply with our Privacy Policy and any other appropriate confidentiality and security measures. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING STATEMENTS, ObservePoint MAKES NO WARRANTY THAT ObservePoint WILL MEET USER'S REQUIREMENTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES ObservePoint, INC. MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SITE.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM ObservePoint, INC. OR IN THE COURSE OF USING ObservePoint SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN. YOU ACKNOWLEDGE AND AGREE THAT ANY MATERIAL AND/OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN RISK. YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGES TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS IN THE DOWNLOADING OF ANY FILES ON THE SERVICE OR ANY EXTERNAL LINKS AVAILABLE ON THE SERVICE.

13) Limitation of Liability

SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT, RESULTING FROM THE USE OR THE INABILITY TO USE THE SITE OR MESSAGES RECEIVED OR PRODUCTS OR SERVICES PURCHASED OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF USER'S TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, EVEN IF ObservePoint, INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

14) Legal Jurisdiction

Terms and Conditions will be governed and construed, to the extent applicable, in accordance with Utah law. The parties hereto consent to exclusive jurisdiction and venue in the courts of Utah County, State of Utah or the United States Federal District Court located in Salt Lake City. The parties further agree not to disturb such choice of forum, and if not resident in such state, waive the personal service of any and all process upon him or her, and consent that such service of process may be made by certified or registered mail, return receipt requested, addressed to the parties as set forth herein.

15) Patents Pending and Non-Disclosure

By accessing this Website and/or submitting any information to ObservePoint, you agree that you are receiving confidential information and technology which is protected by intellectual property laws, current Patent Pending's and this non-disclosure.
